Britni By Design: Licensing

The following applies to my DevaintArt, Flickr, Myspace, Facebook, Zazzle account or anywhere else on the web where you could find my artwork and photos. Legal action will be taken for violations.

All designs are owned by the BritniByDesign designer and owner. Scanning any printed material to create or print any other type of marketing material such as signs, postcards, menus, etc. or anything without the express written permission of this site owner BritniByDesign is liable and subject to pay a licensing fee of $2500 dollars USD, per image, per violation (creation or print).

Have any items printed at a third party venue (like Minuteman Press) for scanning and printing the image without the express written permission of BritniByDesign is liable and subject to pay a licensing fee of $2500 dollars USD, per image, per violation (creation or print).

Scanning any printed material in order to bypass Zazzle printing fees is liable and subject to pay licensing fees of $2500 dollars USD, per image, per violation (creation or print).

Making derivative works of illustrations and/or designs (items that look like the artwork of BritniByDesign) without expressed and written consent is considered copyright infringement and prosecuted to the full extent of the law and is liable and subject to pay licensing fees of $2500 dollars USD, per image, per violation (creation or print).

Zazzle terms of use state "You may not use or distribute any Content received (designed goods purchased) through the Site without the authorization of the Content owner (designer). You agree not to publish, reproduce, copy, in whole or in part, nor upload, download, post, email, sell, or otherwise distribute Content available through the Site, in violation of applicable copyright and other intellectual property laws."

Purchasing a License for Web, Print or Branding

Purchasing and Licensing images from BritniByDesign means you are granted permission to use an agreed upon image for a specific business venture or personal use. Each license is unique to meet the requirements of the licensee.

There a 4 kinds of license, Web, Print, Branding and Image royalty.

WEB

This type of license defines the terms for an image to be used and displayed on the web. The image is usually delivered in a JPG format. The image will also have a digital signature, invisible on the graphic. The digital signature ensures that the image can be tracked in case of theft. Removal of this signature by the licensee voids and terminates this contract, and all rights are returned to the designer.

If a third party, like a web developer will need to handle the image, they will also need to uphold the licensing terms and agree in writing. If they choose not to agree, then the licensee will be held liable for any mishandling on the part of the third party.

This type of license defines an image, either in color or black and white for print. This image is usually delivered in a EPS and jpg and tiff. You may edit this image to adapt it to your project and branding and add text, but may not create derivatives of this artwork for resale or giving away.

BRANDING

This one covers web and print and the same terms as mentioned above apply. Though a larger fee applies, you have more freedom over the image, as you can brand yourself with the image just as you would a custom logo and you may use the image on a variety of projects.

IMAGE ROYALTIES

This particular license allows you to earn money from the image, such as when creating products like t-shirts, housewares, and any goods that generate sales. For this, a flat fee applies. This does not allow you to brand yourself, display on the web or print the images, unless the images are on the intended product in which it will be produced.
